1. Acceptance of Terms

By creating an account or using the Ballpark Announcer application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Ballpark Announcer LLC ("Company", "we", "us", or "our").

2. Description of Service

Ballpark Announcer is an AI-powered sports announcement platform that allows coaches and team managers to generate custom player walk-up announcements, team introductions, and game-day audio experiences for youth and amateur sports teams.

Features include:

• AI text-to-speech player and team announcements
• Custom music assignment and walk-up song management
• Defense and offense lineup introductions
• Guest team access sharing
• Baseball IQ quiz module

3. Accounts and Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately at ballparkannouncer@gmail.com of any unauthorized use of your account.

You must be at least 18 years old to create an account. By registering, you represent and warrant that you meet this requirement.

4. Subscription and Billing

Access to the App requires a paid subscription after a 7-day free trial period. Subscription fees are billed monthly at $9.99 USD per month unless cancelled before the trial ends.

• Free Trial: Your 7-day free trial begins on the date you provide your payment information. You will not be charged during the trial period.
• Automatic Renewal: Your subscription automatically renews each month unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your Stripe billing portal. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
• Price Changes: We reserve the right to change subscription pricing with 30 days' notice.

All payments are processed securely by Stripe. We do not store your payment card information.

5. Acceptable Use

You agree not to use the App to:

• Generate announcements containing profanity, hate speech, or content that discriminates against any individual or group
• Harass, threaten, or demean players, coaches, or other users
• Upload or distribute content that infringes on third-party intellectual property rights
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any illegal purpose or in violation of any applicable laws
• Share account credentials with unauthorized third parties

We reserve the right to suspend or terminate accounts that violate these guidelines without refund.

6. AI-Generated Content

The App uses third-party AI text-to-speech technology (ElevenLabs) to generate audio announcements. You acknowledge that:

• AI-generated audio may occasionally contain errors, mispronunciations, or unexpected outputs
• You are responsible for reviewing announcements before use at live events
• Generated content is for personal, non-commercial sports team use only
• We do not guarantee the accuracy, quality, or appropriateness of AI-generated content

7. Data and Privacy

By using the App, you consent to the collection and use of data as described in our Privacy Policy. Player data you enter (names, jersey numbers, positions) is stored securely on our servers and is used solely for generating announcements for your team. We do not sell personal data to third parties.

Team access sharing features allow you to grant other users access to your team data. You are responsible for who you grant access to and their use of that access.

8. Intellectual Property

The App, its design, logo, branding, and underlying technology are the exclusive property of Ballpark Announcer LLC. You may not reproduce, distribute, or create derivative works without our express written permission.

Music tracks available in the App are licensed for use within the App only and may not be downloaded, redistributed, or used outside of the App.

9. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLPARK ANNOUNCER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ballpark Announcer LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App immediately ceases. Provisions of these Terms that by their nature should survive termination shall remain in effect.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and you waive any right to a jury trial.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
